Reasons for Exemption
The Local Agency Formation Commission has determined that adoption of the revised Schedule of Fees, Deposits and Charges is statutorily exempt from environmental review pursuant to the provisions of Section 21080(b)(8) of the California Environmental Quality Act (CEQA) and Section 15273(a), Subsections (1 ), (2), and (3), of the CEQA Guidelines which specifically address the issue of the modification of rates, fees and charges. This determination is based on the following findings: (a) filing and processing fees are authorized by Government Code Section 56383 to cover the estimated reasonable cost of providing the service; and (b) the rates and charges identified in the Schedule of Fees, Deposits and Charges are for the purpose of: 1) meeting operating expenses, including employee wage rates and fringe benefits; 2) purchasing or leasing supplies, equipment, or materials; and 3) meeting financial reserve needs and requirements. Therefore, adoption of the revised Schedule of Fees, Deposits and Charges is not subject to environmental review under the provisions of the CEQA and the of CEQA Guidelines sections cited above or the Commission's adopted CEQA Guidelines.
