Document Description
An application to the Zoning Administrator for an amendment to a recorded Parcel Map to remove a 1.23-acre portion of the “No Building Area” on Parcel 1 of the Map recorded in Book 12 of Parcel Maps at Page 169 (PM77-315) requiring that building sites and driveways be restricted to areas with 20% slope or less. The current property owner has applied for this amendment to modify the slope restrictions to be consistent with the current Nevada County Land Use and Development Code, which defines steep slopes as those areas which exceed 30%. The amended map will also delineate areas of 30% slope or greater, consistent with Section L-II 4.3.13 of the Nevada County Land Use and Development Code.

Given that no sensitive environmental resources were identified on the parcel and development on slopes greater than 30% is prohibited without an approved Management Plan, the project would be Exempt from environmental review under the California Environmental Quality Act Guidelines Section 15061(b)(3) because CEQA applies only to projects which have the potential for causing a significant effect on the environment. It can be seen that there is no possibility that the activity in question will have a significant effect on the environment.
