Reasons for Exemption
The action of the BBCCSD Board of Directors to adopt Ordinance No. 2023-03 is exempt from environmental review under the California Environmental Quality Act (“CEQA”) because the adoption of the Ordinance is to facilitate operational improvements for water and sewer services. (Pub. Resources Code, § 21080(b)(8); State CEQA Guidelines, § 15273(a)(1)-(4).) The Water and Sewer Code of Regulations is reasonably related to the operation of water and sewer facilities and the adoption of the Water and Sewer Code of Regulations will not expand BBCCSD’s existing system. Additionally, the approval of Ordinance No. 2023-03 is not subject to CEQA because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. (State CEQA Guidelines, § 15061(b)(3).) Finally, the adoption of Ordinance No. 2023-03 is not a “project” under CEQA because it is the creation of a government funding mechanism or fiscal activity that does not involve a specific commitment to a specific project that may result in a potentially significant impact on the physical environment. (State CEQA Guidelines, §15378(b)(4).)
