Reasons for Exemption
Ordinance No. 1305 (Oct 2020) amended Chapter 16.15 of the Santa Paula Municipal Code to permit all housing ‘by-right’ in all Commercial zones (C-N, C-O, CBD, C-G and C-LI) without discretionary review consistent with the purpose and intent of Government Code Sections 65583.2(h) and (i). The California Environmental Quality Act (‘CEQA’) does not apply to activity that does not involve the exercise of discretionary powers by a public agency. (State CEQA Guidelines, § 15060(c)(1).) Ministerial projects are thus exempt from CEQA. (State CEQA Guidelines, § 15268(a).) Here, the project is permitted by-right and thus qualifies as a ministerial project not subject to CEQA.
