Title Continued: Kern-Tulare Water District's Kern River Water. Improvement District No. 4 (ID4) will exchange up to 23,000 af of 2023 State Water Project (SWP) Table A water with Kern-Tulare Water District's (Kern-Tulare) for an equal amount of Kern River water. The SWP water will be delivered to Kern-Tulare into the discharge side of Pumping Plant No. 6 in the Cross valley Canal (CVC) or at other mutually agreeable locations as allowed by the August 8, 1988 Exchange Agreement between Kern-Tulare and ID4. The exchange of SWP Table A water for Kern-Tulare's Kern River water will facilitate in-district delivery of Kern-Tulare's Kern River water and provide ID4 an economic benefit by foregoing pumping lifts through the CVC. Kern River water is also typically easier to purify therefore ID4 will receive an economic benefit in reduced treated water chemical costs. All other mutually agreeable locations are located within the Kern groundwater basin so that the total water supply to Kern County is not diminished. There is no construction, land use change, or modification to existing facilities; no new lands will be brought into production as a result of the exchange.

CEQA Guidelines Section 15061(b)3 provides a lead agency may determine an activity to be exempt based on a general rule that CEQA applies only to projects that have a potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The Agency finds that approval of the proposed water transfer has no possibility of significant effect on the environment for the following reasons: 1. The proposed action consists of a one-time water transfer that will use existing facilities and would not require any construction or grading; 2. The proposed action does not constitute a new permanent source of water supply and will not result in any growth inducing or cumulative environmental impacts; 3. There will be no change in land use.
