Document Description
Amidst the severity of winter storms that are causing damage in numerous communities, the Governor of California declared a state of emergency for the state, including Orange County in that declaration on March 14, 2023. In response OC Waste & Recycling is requesting to accept waste tonnage beyond daily Solid Waste Facility Permit (SWFP) limits until the end of the declared emergency and through June 26, 2023, at its Prima Deshecha Landfill (PDL) in San Juan Capistrano. The maximum daily permitted tonnage will be temporarily increased at PDL from 4,000 tons/day to 6,000 tons/day. By allowing a temporary increase in additional daily tonnage at the County landfill OCWR will be able to mitigate an emergency situation and maintain an essential public health and safety service for the County.

Reasons for Exemption
The proposed project is statutorily exempt from the provisions of CEQA. CEQA Guidelines Section 15269(c) exempts projects necessary to prevent or mitigate an emergency, particularly if (i) the anticipated period of time to conduct an environmental review for such a long-term project would create a risk to public health, safety, or welfare, or (ii) if activities are proposed for existing facilities in response to an emergency at a similar existing facility in an area in which a state of emergency has been proclaimed by the Governor pursuant to the California Emergency Services Act, commencing with Section 8550 of the Government Code. The proposed emergency tonnage acceptance and extension of operating hours at the three Orange County Landfills is consistent with this exemption.
