Document Description
To authorize the existing waterside elevated pump platform structure, catwalk, security gate, electrical conduit, and slope metal steps, the existing landside water valve, an approximately 9-foot long 8-inch diameter supply pipe connected to a booster pump within the Board's jurisdiction, and to install a positive-closure device on the waterside of the levee accessible during high water events. The pump, walkway, and electrical service were noted in the U. S. Army Corps of Engineers as-built drawing no. 50-04-2948, page 3 (station 182+00). This permit is also a "name change" permit and includes conditions that are consistent with the current flood control standards and policies of the Central Valley Flood Protection Board. This permit supplements and where in conflict supersedes the conditions in Permit No. 18229 issued to Mr. Albert Martinelli on October 30, 2007, for the construction of a 16-inch-diameter steel irrigation pipe through the right (west) bank levee of the Sacramento River.

Reasons for Exemption
The Board has determined the project is exempt from CEQA under the Class 1, Existing Facilities categorical exemption (CEQA Guidelines § 15301) because the proposed activity consists of authorizing existing facilities including waterside elevated pump platform structure, catwalk, security gate, electrical conduit, and slope metal steps, the existing landside water valve, an approximately 9-foot long 8-inch diameter supply pipe connected to a booster pump. The project is also exempt under the Class 3, New Construction or Conversion of Small Structures categorical exemption (CEQA Guidelines § 15303) because the proposed activity consists of the installation of a closure device on the levee. Further, none of the exceptions to the exemption in CEQA Guidelines § 15300.2 apply. The Board has determined that an application to change the name of the permittee does not have the potential to result in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and thus, is not a “project” for purposes of the California Environmental Quality Act (Public Resources Code § 21065; CEQA Guidelines § 15378(a)).
