Document Description
Reclamation filed a temporary urgency change petition (TUCP) for the above-mentioned water rights with the Division on January 30, 2023, to request the addition of the Mendota Dam as a point of diversion/rediversion. Reasons for Exemption
The proposed project is consistent with the suspension of CEQA in the Governor's March 28, 2022 Executive Order (EO) N-7-22. Item 12 of EO N-7-22 requires the State Water Board to prioritize water right permits to help advance groundwater recharge projects, and to demonstrate the feasibility of projects that can use available high water flows to recharge local groundwater while minimizing flood risks. This item suspends CEQA, and the regulations adopted pursuant to it, to the extent that CEQA would otherwise apply to actions taken by state agencies for the purposes of carrying out this directive. This TUCP will capture high runoff for delivery to CVP contractors to help recharge aquifers depleted by over 20+ years of drought. Absent the suspension of CEQA pursuant to EO N-7-22, this proposed project would be categorically exempted: (1) Section 15301 exempts actions utilizing existing facilities; (2) Section 15307 exempts actions by regulatory agencies for protection of natural resources, and Section 15308 exempts actions by regulatory agencies for protection of the environment.
