Reasons for Exemption
The proposed action allowing for continued operation, maintenance, repair and testing of the LFG collection systems at various closed sites (Gothard, Cannery) is Categorically Exempt (Class 1) from the provisions of CEQA pursuant to section 15301 of the CEQA Guidelines, since section 15301 exempts projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographic features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The proposed action is also separately and independently Categorically Exempt (Class 4) from the provisions of CEQA pursuant to section 15304 of the CEQA Guidelines, since section 15304 (Minor Alterations to Land) exempts projects involving minor alterations to land. The proposed action is also separately and independently Categorically Exempt (Class 8) from the provisions of CEQA pursuant to section 15308 (Actions by Regulatory Agencies for Protection of the Environment), since section 15308 exempts actions taken by a public agency for the protection of the environment. This contract will allow for continued LFG maintenance services at Central Region closed landfills, and contract work at closed sites will only serve to enhance environmental protection and site integrity associated with ongoing closed-site maintenance activities, in conformance with environmental protection requirements pursuant to monitoring, reporting and compliance agreements with regulatory entities for ongoing closed site maintenance, which is consistent with a Class 1, Class 4, and Class 8 Categorical Exemption determination.
