Document Description
To revoke Permit Nos. 6292-A GM; 6292-A, and 6292 and order the removal of the authorized encroachments. The United States Army Corps of Engineers (USACE) has identified encroachments that are within the construction footprint of the American River Watershed Common Features 2016, Sacramento River East Levee Contract 4 Project (SRELC4 Project) that require removal, including those authorized under Permit Nos. 6292-A GM, 6292-A, and 6262. Encroachment removal actions are governed by Water Code Section 8702, which allows the Board to “order the removal or modification of an encroachment that was previously issued a permit by the board. The permitted encroachments under Permit Nos. 6292-A GM, 6292-A, and 6292 are within the SRELC4 Project construction footprint and significantly impair the functional capability of the levee to fulfill its intended role in the overall flood control plan.

Reasons for Exemption
The CVFPB has determined the enforcement action to revoke and order removal of encroachments authorized under Permit Nos. 6292-A GM, 6292-A, and 6262 is categorically exempt in accordance with CEQA Guidelines Section 15321 under Class 21(a), Enforcement Actions by Regulatory Agencies. Additionally, these encroachment removals were discussed and analyzed within the USACE and CVFPB’s joint document for the SRELC4 Project Supplemental Environmental Assessment/Environmental Impact Report (State Clearinghouse No. 2005072046, October 2022), and no further CEQA analysis is required pursuant to CEQA Guidelines Section 15162.
