Document Description
The purpose of the Agreement Among the Department of Water Resources (DWR), Alameda County Water District (ACWD) and Kern County Water Agency (KCWA) for storage of a portion of Alameda County Water District’s State Water Project Water Supplies in Semitropic Water Storage District (proposed project) is to execute a new agreement (2023 Agreement) to extend the expired terms of the previous 2010 Point of Delivery agreement for an additional ten years to enable the continued delivery of a portion of ACWD's SWP water supplies to the Semitropic Program for temporary storage, and to update terms, the description of operations, and the determination of charges. The 2023 Agreement extends the deadline for which ACWD may deliver its approved SWP water supplies to KCWA for storage from December 31, 2020 to December 31, 2030. ACWD will still recover its stored water by December 31, 2035. Additionally, this 2023 Agreement updates terms, the description of operations, and the determination of charges.

Reasons for Exemption
The proposed project qualifies for a Categorical Exemption under CEQA Guidelines Section 15301 (Existing Facilities) because the transfer and storage of the water under the 2023 Agreement involves the continued operation of existing water supply diversion, storage, and conveyance facilities with no expansion of use and would not expand the ACWD’s allocated water supply use. The construction of new, expanded, or modified facilities is not required to implement the transfer and storage and it does not result in significant environmental impacts, and does not involve unusual circumstances, a uniquely sensitive environment, or significant cumulative impacts from projects of the same type in the same place. The project qualifies for a Categorical Exemption under California Environmental Quality Act (CEQA) Guidelines §15301: “Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use.” None of the exceptions under the CEQA Guidelines §15300.2 exist.
