Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number EPIMS-HUM-33038-R1C, pursuant to Section 1602 of the Fish and Game Code to Mr. Harry Hardin. The project is limited to 3 encroachments. One encroachment is to remediate an unpermitted water diversion from an unnamed tributary to Martin Creek. Another encroachment is to upgrade, use and maintain a water diversion from Jewett Creek. Water diverted from this location will be diverted for domestic use only. The other proposed encroachment is to upgrade an existing culvert. Work will include excavation, culvert removal, culvert replacement, backfilling and compaction of fill, and rock armoring as necessary to minimize erosion.

Reasons for Exemption
The project will permit remediation of an existing stream crossing and two water diversions, involving some minor alterations to land for upgrading and decommissioning work. The authorized work is also part of an administrative case and settlement agreement. There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
