Document Description
The California Department of Fish and Wildlife has executed Streambed Alteration Agreement number EPIMS-SIS-34203-R1, pursuant to Section 1602 of the Fish and Game Code to Shasta River Water Association, represented by Rick Brooks. The project is limited to: 1) diversion of water, and 2) the removal of silt/sand/gravel (sediment) from in front of and alongside of the pumping station. The Permittee has water rights pursuant to Decree #7035 of the Superior Court of the State of California (Decree) in and for the County of Siskiyou judgement for Shasta River. The Permittee has a water right of 42 cubic feet per second (cfs) beginning on April 1 and ending on October 1 of each year for irrigation and stock water. This agreement includes a winter water right once approved by SWRCB. The diversion facility is a pumping station with fish screen, sweepers, and pump which the Permittee maintains and operates. Sediment removal work includes removal of material with heavy equipment (excavator or backhoe) from the bank from 100 feet upstream of the pumping station to the first boulder weir downstream of diversion. All removed material will be hauled offsite. At no time will heavy equipment be operated in the active stream channel. Vegetation on the banks shall be minimally disturbed as needed to access the wetted channel. Any additional work will be done with a work plan approved, in writing, by CDFW prior to work commencing.

Reasons for Exemption
The Project is limited to operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features with negligible or no expansion. The diversion facilities are currently in good working order. Therefore, the continued use of these facilities is consistent with a Class 1 exemption, and no unusual circumstances exist with regard to this facility at this time.
