Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration
Agreement EPIMS Notification No. EPIMS-MEN-33060-R1, pursuant to Section 1602 of the Fish and Game Code
to Jennifer Formoso.
This Agreement relies on the Notification materials and a CDFW site inspection on September 7, 2022.
The project is limited to one (1) encroachment. This encroachment is for seasonal maintenance and use of an
existing low water crossing within Outlet Creek. Maintenance will include relocation of up to 40 cubic yards of dry
gravel materials (located outside of the wetted channel) annually using heavy equipment. Heavy equipment will
cross the wetted channel twice per year (one pass each direction) and vehicle crossings will be limited to a total of
40 crossings per year (20 passes each direction).

The Formoso seasonal low water crossing project meets the criteria for
categorical exemption type Class 4; California Code of Regulations, Title 14, Section 15304 because the project
consists of minor alterations in the condition of land, water, and/or vegetation, which does not involve removal of
healthy, mature, scenic trees. There will be no significant adverse impact on endangered, rare, or threatened
species, or their habitat pursuant to Section 15065.
