Document Description
Levee District 1 (LD1 ) proposes to (1) annex 4.9 miles of the Feather River West Levee from the confluence of the Sutter Bypass to the southern border of LD1 , and (2) to amend its sphere of influence to include the same area. The levee situated In the project area is currently maintained by the State of California. LD1 would assume responsibility for the operation, maintenance, repair, rehabilitation, and replacement of the portion of the Feather River West Levee within the project area.

The Proposed Project qualifies for the Common Sense Exemption because it can be seen with certainty that there is no possibility that the proposed Project would have a significant effect on the environment. LD1 would assume responsibility from the State of California for the operation, maintenance, repair, rehabilitation, and replacement of the project area in the same manner and to the same extent as has historically occurred. There would be no expansion or change in services provided to the project area. The proposed Project would only result In a change in the agency providing identical services.

Reasons for Exemption
The exemption for Annexations of Existing Facilities applies because LD1 is a special district proposing to annex public or private facilities, developed to an allowable density, with the capacity only to serve the existing facilities. The proposed Project would result only in the assumption of services from the State of California. It would not result in increased growth, development, or need or capacity for services. Unrelated population growth within the project area would not result in an increased need for services in the future, as LD1's operations are unrelated to population and would remain constant.
