Reasons for Exemption
An exemption is appropriate for determining to carry out the CityBus Electrification
Infrastructure Construction Project and awarding the construction contract for the
construction of Phases 1 & 2 of the Project and, pursuant to California Public Resources Code (PRC) Section 21080.25 (consistent with SB922 enacted September 2022), which provides exemptions for the construction of infrastructure to charge or refuel zero-emission transit buses and the maintenance, repair, relocation, replacement, or removal of any utility infrastructure associated with the zero-emission transit infrastructure. Further, any subsequent approvals would be subject to appropriate CEQA analysis.
