Document Description
The California Department of Fish and Wildlife has executed Streambed Alteration Agreement number EPIMS-SIS-31290-R1, pursuant to Section 1602 of the Fish and Game Code to Harold B. Tozier Ranch, represented by Pamela Tozier Hayden. The project is limited to activities associated with the two diversions of water on Shackleford Creek. The Permittee diverts water from Shackleford Creek pursuant to Decree #13775 of the Superior Court of the State of California in and for the County of Siskiyou judgement for Shackleford Creek. Each existing diversion facility include a headgate, a conveyance ditch, a fish screen, and a fish screen bypass return. A rock weir is near each point of diversion. The fish screen and fish screen bypass return are currently inspected, operated, maintained, and repaired by CDFW. Permittee may remove debris and excess sediments from the vicinity of the point of diversions by hand as specified herein. Permittee can construct a temporary dam by hand during summer using stream sediments (gravel and rocks), sandbags, or other materials approved by CDFW.

Reasons for Exemption
The Project is limited to operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features with negligible or no expansion. The diversion facilities are currently in good working order. Therefore, the continued use of these facilities is consistent with a Class 1 exemption, and no unusual circumstances exist with regard to this facility at this time.
