Notice of Exemption

Exempt Status
Emergency Project
Type, Section or Code
Sec. 21080(b)(4); 15269(b)(c)
Reasons for Exemption
The District has been under a declaration of a water supply emergency since August 12, 2018 after the District lost use of two (2) of its operational water supply wells due to casing damage caused by land subsidence. One well has been lost permanently while one well currently produces one-half of its capacity and experiences water quality that approaches the Secondary Maximum Contaminant Level (MCL) threshold for conductance (salinity). A third District well constructed in 2020 has experienced a reduction in production capacity caused by a drop in water levels due to drought conditions. A local state of emergency was declared by the Kings County Board of Supervisors in April, 2022 due to the current drought conditions.
