Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Procession Code Division 10, Chapter 2, Section 26012, approved a Cannabis Processing License submitted on 01/25/2022, by Michael Warm. Michael Warm applied for a Processing license within two existing buildings (Main Building and Corner Building). The Main Building is a ~19,330 sq. ft. multi-story commercial structure and the Corner Building is a ~4,320 sq. ft. single-story commercial structure.

Reasons for Exemption
The proposed Project consists of distribution and processing of cannabis products within two existing commercial structures located in the City of Ukiah’s Manufacturing Zoning District. The Project includes tenant improvements to the existing buildings and does not include ground disturbance or site expansion. Water and electricity are currently on-site, proposed water usage is sourced from a retail water supplier and electricity from the grid.
Section 15061(b)(3) of the CEQA Guidelines states that CEQA review applies to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the subject is not subject to further CEQA review. Department staff reviewed the project for potential impacts to the environment, and no impacts were identified to occur as a result of the proposed project.
The project site is located on an identified Cleanup Site as defined by the Department of Toxic Substance Control (DTSC) EnviroStor database. Potential onsite screening for contamination occurred on 07/27/1988 and 05/28/2008. On 05/28/2008, site screening was approved by the Environmental Protection Agency (EPA) with a determination that the site contained no significant evidence of hydrocarbon release. An EnviroStor records search indicates the status of the project location as No Action Required with a site screening conclusion of No Action Needed.
Because the record evidence shows with certainty that the Department’s issuance of a license will not bring about any physical change in the environment and will not have the potential to cause a significant effect on the environment, the Project is exempt from CEQA review under the common sense exemption of CEQA Guidelines section 15061(b)(3).
