To remove and replace, in-kind, approximately 110 feet of 18-inch diameter steel irrigation pipe and a 1.25-inch diameter steel conduit through the left bank levee, and to repair minor erosion authorized by Permit No. 3300. To remove approximately 50 feet of abandoned 12-inch diameter steel pipe atop the levee waterside slope and approximately 12 feet of abandoned 18-inch diameter PVC pipe. This is a "name change" permit that includes conditions that are consistent with current flood control standards and policies of the Central Valley Flood Protection Board. This permit supplements Permit No. 3300 that was issued to Mr. Lloyd L. and Mrs. Thelma B. Phelps on 3/2/1960 for installation of a pumping plant and pipe through the left bank levee of the San Joaquin River.

Reasons for Exemption
Board staff has determined the project is exempt from CEQA under the Class 1, Existing Facilities categorical exemption (CEQA Guidelines § 15301) because the proposed activity consists of the removal of existing features including approximately 50 feet of abandoned 12-inch diameter steel pipe and approximately 12 feet of abandoned 18-inch diameter PVC pipe. The project is also exempt under the Class 2, Replacement or Reconstruction categorical exemption (CEQA Guidelines § 15302) because the proposed activity consists of the removal and replacement (in-kind) of approximately 110 feet of 18-inch diameter steel irrigation pipe and a 1.25-inch diameter steel conduit, and minor erosion repair. In addition, the proposed action includes a name change. An application to change the name of the permittee does not have the potential to result in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and thus, is not a “project” for purposes of the California Environmental Quality Act (Public Resources Code § 21065; CEQA Guidelines § 15378(a)). Further, none of the exceptions to the exemption in CEQA Guidelines § 15300.2 apply.
