Reasons for Exemption
The State CEQA Guidelines provide a series of Statutory Exemptions for actions that have been deemed by the State Legislature not to be subject to the California Environmental Quality Act (CEQA), i.e., not a project under the CEQA Statute. The proposed action is the installation of an approximate 3,200 feet of new pipeline (12" in diameter) that would allow continued delivery of adequate water supply along the length of this new pipeline alignment. Statutory Exemption 15282 states: (k) The installation of new pipeline or maintenance, repair, restoration, removal, or demolition of the existing pipeline as set forth in Section 21080.21 of the Public Resources Code, as long as the project does not exceed one mile in length, The proposed action has been determined to fall within the scope of Statutory Exemption 15282(k). Therefore, this proposed action is not a “project” subject to CEQA or the State CEQA Guidelines.
