Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Class 1, Existing Facilities CEQA Guidelines §15301
Reasons for Exemption
Board staff has determined that the project is exempt from CEQA under the Class 1, Existing Facilities categorical exemption (CEQA Guidelines § 15301), because the activity consists of permitting existing facilities. These facilities were previously authorized under Automatic Board Order (ABO) 10074 and also referenced in USACE O&M, Unit 128, March 1960, Revised December 29, 2016, (levee mile 6.53). USACE As-built Drawing No. 50-04-3263, sheets 13.1, 15, 42.3 and 46, station 59+97 (site “F”), January 24, 1958. No expansion of existing or former use will occur. This is an administrative change to ABO 10074 to reflect current and existing facilities subject to the property owner. Further, none of the exceptions to the exemption in CEQA Guidelines § 15300.2 apply.
