Document Description
This project would result in a new well to replace an underproducing well ("Cotton Gin" well) that is anticipated to fail in the near future at the Visalia Disposal Site (Landfill). The replacement well will relieve the failing well and will supplement the water drawing capacity of a second well at the Landfill. Without the new well, the second well could be jeopardized as it does not sufficient water drawing (pumping) capacity to meet the needs of the Landfill. The primary function of the new well is to provide water necessary to comply with dust control and thereby maintain compliance with the San Joaquin Valley Unified Air Pollution Control District's Regulation VIII (Prohibitions for Fugitive Dust). Also, the new well will not result in an increase of the overall water usage at the Landfill; it is intended to replace the water drawing capability of the Cotton Gin well. The Cotton Gin water well would remain operational to only supply water to the buildings and not to draw water for usage for dust control. As such, the emergency replacement of the failing well with a new well would provide water for dust control at the landfill and is thereby vital to protect the health and safety of the public ( and County staff on site).

Reasons for Exemption
This activity/project is intended and necessary to protect the health and safety of the public (and County staff) through the installation of a new, emergency replacement well that is primarily used to draw water for dust control purposes and thereby comply with the San Joaquin Valley Unified Air Pollution Control District's Regulation VIII (Prohibitions for Fugitive Dust). Title 14 of the California Code of Regulations, § 15269 sets forth emergency projects that are exempt from the requirements of the California Environmental Quality Act (CEQA). The installation of the new well at the landfill falls within the scope of CCR § 15269(c) as it is a specific action necessary to prevent or mitigate an emergency. Public Resource Code § 21080(b)(4) also exempts the installation of the new well from CEQA as necessary to prevent or mitigate an emergency. As such, the activity/project is exempt from the California Environmental Quality Act (CEQA) pursuant to Title 14 California Code of Regulations, § 15269. Therefore, the application of CEQA Section 15269 is applicable and appropriate for this project.
