Document Description
Section 12.36.075.C "Alternative mitigation for tree replacement including payment of contribution in-lieu of tree planting" of the Municipal Code establishes the authority to adopt an "In-Lieu Tree Mitigation Contribution" to aide development projects in satisfying tree planting mitigation standards. The ordinance allows alternatives to on-site replacement treeplanting upon a finding that the alternate measure is consistent with the purpose and goals of the ordinance. In-lieu contributions will be collected prior to tree removal, after approval for use by the permitting authority. The City will utilize these funds to purchase, plant, maintain and monitor trees on public lands, or on private lands where appropriate protections have been established.

Reasons for Exemption
This planning activity is categorically exempt under Title 14 of the Cal. Admin. Code Section 15262 (feasibility and planning studies), and on a separate and independent basis is covered by CEQA Guidelines Section 15308, “Actions by Regulatory Agencies for Protection of the Environment.” It can be seen with certainty that the adoption of the mitigation fee will not have a significant effect on the environment. The adoption of the fee and planting program is for the purpose of environmental protection and restoration, and it is not a commitment to any future action, nor is it a decision to approve, adopt, or fund any of the potential mitigation actions which may be.
