Document Description
The California Department of Toxic Substances Control (DTSC), approved a Class 2 Permit Modification (Modification) for the ground water monitoring section of the Clean Harbors Buttonwillow, LLC. (Facility) Hazardous Waste Management Permit, pursuant to authority granted under California Health and Safety Code Chapter 6.5 and California Code of Regulations, title 22, division 4.5, chapter 20. The Facility requested a Class 2 Permit Modification. Declining water levels, due to drought conditions and regional decreases of groundwater levels, has resulted in existing groundwater monitoring wells being unable to yield any representative groundwater samples. The Modification will authorize the modification of the ground water monitoring program to change the status of four monitoring wells (MW-127U, MW-128I, MW-168L and MW-169L) from dry background wells to piezometers and to install four replacement wells (MW-127RU, MW-128RI, MW-168L, and MW-169L).

Reasons for Exemption
DTSC has evaluated whether any of the exceptions to the categorical exemptions apply to this project, as described in Public Resources Code section 21084, subdivisions (c), (d), and (e), and California Code of Regulations, title 14, section 15308. DTSC has determined that no exceptions to the categorical exemption apply to this project. The installation of replacement groundwater monitoring wells is consistent with the actions taken by regulatory agency, to assure the maintenance, restoration, enhancement, or protection of the environment. This approval will ensure the Facility is appropriately sampling groundwater to monitor and manage any potential releases.
