Exempt Status
Categorical Exemption
Type, Section or Code
Class 4 and Class 6, CEQA California Code of Regulations, Title 14, Section 15304, 15306
Reasons for Exemption
The Board has determined the project is exempt from CEQA under the Class 4, Minor Alterations to Land categorical exemption (CEQA California Code of Regulations, Title 14, Section15304) because the proposed activity consists of installing a remote terminal unit, burying metal conduits, constructing concrete pads, and mounting 8-foot-tall staff gauges into the low water channel at the channel toe and does not include the removal of healthy, mature, scenic trees. The project is also exempt under the Class 6, Information Collection categorical exemption (CEQA California Code of Regulations, Title 14, Section 15306) because the proposed activity consists of the installation of flow monitoring stations for data collection and does not result in a serious or major disturbance to an environmental resource. Further, none of the exceptions to the exemption in CEQA California Code of Regulations, Title 14, Section 15300.2 apply.
The Central Valley Flood Protection Board's (Board’s) administrative record related to the encroachment permit is available for public review at the Board's office.
