The project is limited to the implementation of a restoration plan. A violation associated with cannabis cultivation activities was documented on July 13, 2021, and the applicant was issued a Notice of Violation. To satisfy the required mitigation resulting from the violation of Fish and Game Codes 1600, 5650, and 5652, permittee has prepared a restoration plan that details the removal of a water pump used for unpermitted direct diversion from Buena Creek, removal of deleterious material as well as trash and refuse within 150 feet from Buena Creek. The following project activities are proposed to mitigate direct diversion impacts from Buena Creek.

Reasons for Exemption
The California Department of Fish and Wildlife has determined that the Project is categorically exempt from review under CEQA pursuant to California Code of Regulations, Title 14, Article 19, Section 15333 Small Habitat Restoration projects. The project is a small habitat remediation project not exceeding five acres in size to assure the maintenance, restoration, enhancement, or protection of habitat for fish, plants, or wildlife. All work will be performed with hand tools. No vegetation will be removed.
