Reasons for Exemption
The project is for restoration of an existing failing culvert and correction to the erosion that is currently threatening State Route 1. The project materials document erosion occurring below culvert outlets within the project area and, consistent with the class 1(d) exemption, provides for the rehabilitation of the drainage facilities and in turn the roadway prism to meet current public health and safety standards. None of the exceptions to Categorical Exemptions provided in CEQA guidelines section 15300.2(b) through (f) are application to the subject project. There are no cumulative impacts of successive projects of the same type in the same place, over time that result in significant environmental effects. There have been emergency repairs and regular maintenance conducted to this drainage system and section of State Route 1 over the years but County staff is not aware of a project in this location that was the same type and over time results in significant environmental effects. There are not unusual circumstances related to the project site such that the activity may have a significant effect on the environment, as detailed in the numerous studies prepared for this project. State Route 1 is not an officially designated state scenic highway. The site is not a hazardous waste site on any list compiled pursuant to Section 65962.5 of the Government Code. The project will not result in a substantial adverse change to the significance of any historical resource within the project area, as documented by the response from the Sonoma State University Northwest Information Center on August 30, 2021. Conditions of approval were adopted by the Mendocino County Coastal Permit Administrator requiring that the project implementation be consistent with the recommended BMPs and avoidance and minimization measures outlined in Sections 1.2, 1.3, and 3.5 of the ESHA Assessment, July 2019, Section 1.4 of the Natural Environment Study, July 2017, and Sections 4 through 8 of the Revegetation Plan intended to protect ESHA.
