Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Procession Code Division 10, Chapter 2, Section 26012, approved a Cannabis Distribution License and Cannabis Cultivation License submitted on 10/2021, by Ted Elliott. CUBS DEN LLC applied for distribution and cultivation licenses out of an existing facility located at 1665 East 5th Street, Camarillo, 93012 (APN 230-0-062-200). The Project site will include one cultivation license and one distributor license. Cannabis will be cultivated within the existing 18,144 sqft. greenhouse that was previously used for agricultural production. The greenhouse has existing electrical, plumbing, cooling, and air circulation infrastructure. Harvested cannabis will be dried, trimmed, cured, and stored within an approximately 1,200 sqft. portion of the existing 1,800 sqft. shed. The remaining 600 sqft. portion of the shed will be used for distributor operations (e.g., administration and storage). The shed has existing electrical, and cooling infrastructure. Installation of a prefabricated 8’x20’ sealed and lockable cargo container with secondary containment as the hazardous materials storage area. The Project will consist of 18,144 square foot greenhouse and 1,800 square foot shed for distribution and cultivation activities. The project will not expand the existing structures and there are interior modifications proposed to both structures.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is a Class 1, Class 4, and Class 11 Categorical Exemption Project. Class 1 Categorical Exemptions consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations to existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. Class 4 Categorical Exemptions consist of minor trenching and backfilling where the surface is restored. The proposed project will install a silt fence by trenching along an existing chain-link fence, securing the silt fence to the ground with stakes, and then backfilling the trench. Class 11 Categorical Exemptions consist of construction, or placement of minor structures accessory to existing commercial, industrial, or institutional facilities. The proposed project is a request to place a prefabricated sea shipping cargo container to level ground. The Project involves the use of an existing industrial building which was formerly used as an agriculture facility with no proposal for building expansion. The design, location, size, and operating characteristics of the Project are compatible with the existing and future land uses within the vicinity as it is zoned light industrial zoned. None of the exceptions to the exemption defined in Section 15300.2 apply to the Project.
