Reasons for Exemption
The project is exempt from CEQA under the Class 1, Existing Facilities; Class 2, Replacement or Reconstruction; and Class 4, Minor Alterations to Land (CEQA Guidelines §§ 15301, 15302, and 15304 respectively). The activity consists of relocation of an existing pipeline structure on the same site and will have substantially the same purpose and capacity. The activity consists of minor alterations which does not involve removal of healthy, mature, or scenic trees and involves negligible or no expansion in use. Further, none of the exceptions to the exemptions in CEQA Guidelines § 15300.2 apply.

Reasons for Exemption
Board staff has determined that the project is statutorily exempt under the provisions of CEQA and the State CEQA Guidelines. The Board’s approval involves issuing an encroachment permit for the relocation of an existing 8-inch refined petroleum products pipeline from the northern side to the southern side of the Union Pacific Railroad Valley Bridge 140.02. The diameter of the existing pipeline will not be increased and is outside the boundaries of an oil refinery and meets all required criteria and is therefore exempt under the statutory exemption of the Public Resources Code Section 15284 (pipelines).
