California Assembly Bill 83, passed in 2020, allows local governments and their co-applicants to acquire properties for the purposes of housing individuals who are homeless or at risk of homelessness due to the economic impacts of the COVID-19 pandemic. Reasons for Exemption
Assembly Bill No. 140 (2021-2022 Reg. Sess.) provided the statutory basis for Round 2 of the Homekey Program by adding section 50675.1.3 to the Health and Safety Code (HSC), and it exempted certain Round 2 Homekey Projects from the California Environmental Quality Act (CEQA) by adding section 50675.1.4 to the HSC. The statutory scheme includes new construction of dwelling units as an eligible use and establishes a set-aside of funds for projects serving Homeless Youth and Youth at Risk of Homelessness. The project involves the acquisition of existing developed properties for housing the homeless and will not have a significant impact on the environment.
