Reasons for Exemption
The proposed project was reviewed for potential exemptions and was found to satisfy the standards of a Class 1 (Existing Facilities) Categorical Exemption as specified within Section 15301 of the California Environmental Quality Act (CEQA) Guidelines. The city has found that the project meets the exemption due to the fact the project is proposed within an existing commercial building where only minor alterations to the building will occur. The use is consistent with the applicable General Plan designation of Mixed Use 1. The zoning classification is Specific Plan. The retail market is a permitted use, with the sale of alcoholic beverages conditionally permitted. The Mixed Use 1 land use designation allows a variety of commercial uses. The site is currently occupied with a commercial building, which will remain, with interior remodeling and exterior façade enhancement. None of the exceptions described in CEQA Guidelines Section 15300.2 are applicable. The city of Whittier has determined that the project will not have a significant effect on the environment and a Notice of Exemption will be filed pursuant to Section 15301, Class 1 (Existing Facilities) of the CEQA Guidelines.
