Notice of Exemption
Exempt Status
Categorical Exemption
Type, Section or Code
15061(b)(3)(General Rule); 15301 (Class 1); 15302 (Class 2) and 15303 (Class 3)
Reasons for Exemption
The project is exempt under Sec. 15061(b)(3) that states that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The project is also exempt under Sec. 15301 for the reason that it entails the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use, such as existing publicly owned utilities used to provide electric power; and Sec. 15302 because the work comprises the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, as is the case of the replacement or reconstruction of existing utility systems and conversion of overhead electric utility distribution system facilities to underground including connection to existing overhead electric utility distribution lines where the surface is restored to the condition existing prior to the undergrounding; as well as under Sec. 15303 given that it involves the construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure like electrical utility extensions of reasonable length.
