Reasons for Exemption
It is the determination of the department that the project is categorically exempt from the provisions of the California Environmental Quality Act pursuant to the Provisions of Title 14 of the California Administrative Code, Section 15301 Existing Facilities because the project proposes a negligible expansion in use of an existing facility and no new development or construction is required to accommodate the project. Additionally, the project is except pursuant to Section 15061 subsection (b) (3) because it can be seen with certainty that there is no possibility that the project may have a significant effect on the environment. Specifically, the project does not incur new construction; the proposed agricultural promotional events will utilize an existing winery and will be accommodated by the existing parking lot, septic system and well; the noise generated by the proposed use will comply with General Plan Noise Standards; and the expected increase in traffic and vehicle miles travelled is negligible. Additionally, the proposed agricultural promotional events are within a 395-acre parcel, more than 1,600 feet from the nearest sensitive receptor (adjacent residence), and set back approximately 800 feet from the nearest property line. No exceptions listed under Section 15300.2 apply. There is no reasonable possibility that the project would have a significant effect on the environment.
