Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
§ 15302, Replacement and Reconstruction
Reasons for Exemption
Board staff has determined that the project is exempt from CEQA under the Class 2, Replacement and Reconstruction categorical exemption (CEQA Guidelines § 15302), because the proposed activity consists of the removal of an existing boat dock and the reconstruction of a new private boat dock located on the same site. The new private boat dock will have substantially the same purpose and capacity as the structure replaced. In addition, this permit would facilitate a name change. An application to change the name of the permittee does not have the potential to result in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and thus, is not a “project” for purposes of CEQA (Public Resources Code § 21065; CEQA Guidelines § 15378(a)). Please note, the NOE is not attached. If you would like to request a signed copy of the NOE, please contact Board Staff at:
