Document Description
To remove the existing boat dock and install a new private boat dock. This permit is also a "name change" permit and includes conditions that are consistent with current flood control standards and policies of the Central Valley Flood Protection Board. This permit supplements and where in conflict supersedes the conditions in Permit No. 15488-Rev issued to Mr. James Tanimoto on April 22, 1997 to construct a floating boat dock secured by wooden piles, a pedestrian ramp, and raised concrete steps on the landward slope and two summer gardens (4.5 x 40.5 feet, 4.5 x 20.5 feet) within 10 feet of the levee toe on the left (east) bank levee of the Sacramento River.

Reasons for Exemption
Board staff has determined that the project is exempt from CEQA under the Class 2, Replacement and Reconstruction categorical exemption (CEQA Guidelines § 15302), because the proposed activity consists of the removal of an existing boat dock and the reconstruction of a new private boat dock located on the same site. The new private boat dock will have substantially the same purpose and capacity as the structure replaced. In addition, this permit would facilitate a name change. An application to change the name of the permittee does not have the potential to result in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and thus, is not a “project” for purposes of CEQA (Public Resources Code § 21065; CEQA Guidelines § 15378(a)).
