Document Description
The proposed ordinance amendments seek to enhance economic development in San Benito County and to achieve parity with surrounding jurisdictions that have adopted less restrictive commercial cannabis regulations. The proposed changes to the ordinance include removing administrative barriers and restrictions, including but not limited to: (1) application review and evaluation, (2) eliminating employee work permit requirements, (3) allowing outdoor cannabis cultivation, ( 4) replacement of the variance requirements with an exception review for setback reductions, ( 5) allowing cannabis distribution, and (6) adding the Airport Safety (AS) District to the zone districts allowing cannabis businesses.

Under CEQA Guidelines 15061(b)(3), CEQA review is not required because it can be seen with certainty that there is no possibility that the adoption of the ordinance will have significant effect on the environment in that all proposed cannabis business operations will be subject to existing best management practices and are subject to issuance of a discretionary conditional use permit with appropriate environmental review.
