Reasons for Exemption
As the Lead Agency, the Parks & Recreation Department has determined that the project is categorically exempt from CEQA under the "Class 1" (14 CCR 15301) (c) exemption per CEQA Guidelines and per PRC 21084 because the project includes replacement of Enginered Wood Fiber in existing playground with a Pour-In-Place rubbersurface for ADA compliance. There is no expansion of existing facility or use. The Department evaluated and determined that there are no exceptions to the otherwise-applicable categorical exemptions (PRC 21084, 14 CCR 15300.2). There is no substantial evidence that there are any "unusual circumstances" associated with the proposed project that create a reasonable possibility that the activity will have a significant effect on the environment, is not located within an environmentally sensitive area and that there are no significant "cumulative impacts" resulting from successive projects of the same type in the same place. Therefore, this project is exempt.
