Exempt Status
Categorical Exemption
Type, Section or Code
21084, 15301(b)
Reasons for Exemption
The State CEQA Guidelines provide a series of Categorical Exemptions for projects that have been deemed to have minimal impacts on the environment. The proposed installation of the Tertiary Effluent Filter Project at the HWWTP facility has been determined to have no potential to cause significant adverse effects on the environment and will ensure the facility continues to operate as is, but with higher quality treated effluent percolating into the local aquifer. Categorical Exemption Class I exempts “operation, repair, maintenance…or minor alteration of existing public or private structures, facilities and mechanical equipment...involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination.” The exceptions to the issuance of Categorical Exemptions have been evaluated for the proposed project activities. The proposed installation and operation of the HWWTP Tertiary Effluent Filter Project has been determined not to have a potential to cause significant adverse environmental effects as a result of any of the exceptions. Therefore, this proposed action is not forecast to cause any potential for significant adverse environmental impacts and qualifies with the requirements for Class 1 exemption.
