Document Description
To authorize a 24-inch diameter steel discharge pipe installed up-and-over the left (north) bank levee of Lindsey Slough. The proposed work was authorized to commence as an emergency repair on September 14, 2017. This is also a “name change” permit and includes conditions that are consistent with current flood control standards and policies of the Central Valley Flood Protection Board (CVFPB). This permit supplements Permit No. 2077 that was issued to the California Packing Corporation on April 8, 1955, "to install a drainage pump with a 30-inch-diameter steel discharge pipe through the levee along the left bank of Lindsey Slough."

Reasons for Exemption
Board staff has determined the project is exempt from CEQA under the Class 1, Existing Facilities categorical exemption (CEQA Guidelines § 15301), because the proposed activity consists of permitting the existing 24-inch diameter steel discharge pipe. Further, none of the exceptions to the exemption in CEQA Guidelines § 15300.2 apply. Please note, the signed NOE is not attached. If you would like to request a signed copy of the NOE, please contact Board Staff at: questions@cvflood.ca.gov. An application to change the name of the permittee does not have the potential to result in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and thus, is not a “project” for purposes of the California Environmental Quality Act (Public Resources Code § 21065; CEQA Guidelines § 15378(a)).
