Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number EPIMS-TRI-15251-R1, pursuant to Section 1602 of the Fish and Game Code to Mr. Kevin Peak. The project is limited to 5 encroachments unnamed tributaries to Wilson Creek and unnamed tributaries to the North Fork Eel River. Three encroachments are for water diversion for domestic use and fire suppression. Work for water diversion will include upgrading existing locations or construction of new location for use and maintenance of the water diversion infrastructure in compliance with this Agreement. One encroachment is to upgrade an existing stream crossing and the other is to remediate unpermitted grading adjacent to a stream. Work for these encroachments will include excavation, culvert removal, backfilling and compaction of fill, and rock armoring as necessary to minimize erosion.

Reasons for Exemption
The project will permit remediation of existing water diversions, stream crossing and minor alteration of land for removal of improperly spoiled sediment grading associated with cannabis cultivation activities. Work was conducted without a Streambed Alteration Agreement (Fish & Game Code [FGC] Section 1602) on or before July 26, 2019. There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
