The Settlement Agreement is between BCDC and RBRA to address vessels unlawfully anchored in RBRA waters including: removing from RBRA waters all marine debris, unoccupied vessels, unregistered vessels, and vessels that are not safe and seaworthy; preparation of a plan with timelines to transition all other unlawfully anchored vessels off the water within a reasonable period; preparation of a plan by RBRA to protect and restore the natural habitat in Richardson Bay; and monthly reporting to BCDC.

Reasons for Exemption
The settlement agreement is categorically exempt from CEQA because it is an action designed to assure the maintenance, restoration, enhancement, or protection of natural resources and the environment and because it is an action by BCDC to enforce laws and rules including without limitation the McAteer-Petris Act, the San Francisco Bay Plan, the Richardson Bay Special Area Plan, and regulations implemented pursuant to these provisions. Any physical construction affecting water or land is temporary and will have no permanent effects on the environment.
