Document Description
Santa Clara Valley Water District (Santa Clara) proposes to exchange up to 100,000 acre-feet of Santa Clara’s CVP water supplies with State Water Project (SWP) water supplies. The U.S. Department of the Interior’s Bureau of Reclamation will make a portion of Santa Clara’s CVP water available to the California Department of Water Resources (DWR) at O’Neill Forebay. DWR will deliver the CVP water to SWP service areas south of O’Neill Forebay under the 2021 Consolidated Place of Use. In exchange, DWR will deliver an equal amount of SWP water supplies to Santa Clara from Banks Pumping Plant to Santa Clara’s turnout(s) in Reach 9 of the South Bay Aqueduct. This involves no increase in total SWP or CVP allocations. This exchange is covered under the 2021 Consolidated Place of Use Order (Order), approved by the State Water Resources Control Board (SWRCB) on July 14, 2021. The SWRCB’s approval is effective July 16, 2021 through July 16, 2022.

a. California Water Code, § 1729, exempts temporary changes in place of use from the requirements of the California Environmental Quality Act. (see also Cal. Code Regs., tit. 14, § 15282, subd. (u).) b. The proposed project is a water management operation using only existing facilities. c. The project will not support new development or a change in land use. d. The project does not establish a new permanent source of water supply.
