Reasons for Exemption
The adoption of the General Plan Amendment GPA2020-01 and Zoning Ordinance Amendment ZOA2021-01 is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Since the Zoning Code Update essentially implements the County of Modoc Housing Element Update and General Plan, and these regulatory updates have been made in accordance with the various State Housing laws, this project will not result in any significant effects on the environment and is therefore not subject to CEQA.
