Document Description
On August 4th, 2021, the Agency’s Board of Directors authorized the Agency’s General Manager to sign an Agreement between San Gorgonio Pass Water Agency and the City of San Buenaventura for the Transfer of 2021 State Water Project Table A Water (the “Agreement”), relating to the exchange of Table A water, and to take all steps necessary to implement the exchange. Under the Agreement, Ventura will request the Department of Water Resources (“DWR”) deliver to the Agency, in calendar year 2021, Ventura’s entire 2021 Table A Water allocation from the State Water Project in the final amounts of the allocations as shall be determined by DWR for 2021. The Table A Water will be delivered to the Agency from the State Water Project through facilities already in existence, such that it will not be necessary to construct additional facilities in order to affect delivery of Table A Water pursuant to the Agreement. The Agreement will not result in any new construction that could potentially impact the environment.

Reasons for Exemption
The Project is exempt under Water Code section 1729 and State CEQA Guidelines section 15282(u), which exempts temporary changes in the point of diversion, place of use, or purpose of use due to a transfer or exchange of water or water rights as set forth under Water Code section 1725, et seq. Here, the Agreement is exempt from CEQA as it involves a temporary exchange of water between the Agency and Ventura pursuant to Water Code section 1725, et seq. The Project is additionally exempt under State CEQA Guidelines section 15061(b)(3), because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The Project merely involves the transfer of an existing allocation of water between the Agency and the City of Ventura. The Project will not increase the pumping of water or the intensity of water use, and the Project does not otherwise authorize activity that could adversely impact the environment.
