Reasons for Exemption
Under Pub. Res. Code § 21080.13, CEQA does not apply to railroad grade separation projects involving reconstruction of existing grade separations. The components of the EBSDT Project within the Commission’s jurisdiction and proposed in the Application involve the Proposed Crossing and the proposed replacement an existing grade-separated single-track with grade-separated double-tracks. This constitutes a reconstruction of existing grade separation, as set forth under Pub. Res. Code § 21080.13, which is statutorily exempt from CEQA requirements.
