Exempt Status
Categorical Exemption
Type, Section or Code
Class 2, Class 4, and Class 33 CEQA California Code of Regulations, Title 14, Section 15302, 15304, 15333
Reasons for Exemption
The Board has determined the project is exempt from CEQA under the Class 2, Replacement or Reconstruction categorical exemption (CEQA California Code of Regulations, Title 14, Section 15302) because the proposed activity consists of the removal of an existing earthen agricultural road crossing and culvert infrastructure with a concrete slab bridge. The project is also exempt under the Class 4, Minor Alterations to Land categorical exemption (CEQA California Code of Regulations, Title 14, Section 15304) because the proposed activity consists of grading activities and rock slope protection placement which does not involve the removal of healthy, mature, scenic trees. The project is also exempt under the Class 33, Small Habitat Restoration categorical exemption (CEQA California Code of Regulations, Title 14, Section 15333) because the proposed activity consists of a culvert replacement to improve habitat or reduce sedimentation. Further, none of the exceptions to the exemption in CEQA California Code of Regulations, Title 14, Section 15300.2 apply. Please note, the signed NOE is not attached. If you would like to request a signed copy of the NOE, please contact Board staff at: questions@cvflood.ca.gov.
