Reasons for Exemption
According to CEOA Guidelines Section 15301, operation, repairs, maintenance, permits, leases, licensing, or minor alterations of existing public or private structures, facilities, mechanical equipment or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. If a project fits within one of the specified exemptions, and does not qualify for any of the exceptions described in State CEOA Guidelines Section 15300.2, a lead agency need not prepare an Initial Study or any other CEOA document. The listed exceptions apply only when the project site is considered environmentally sensitive or located on a hazardous waste site, or if the project would result in cumulative impacts, damage to scenic resources or historical resources, or if any unusual circumstances would result in significant effects. The project described does not fall under the listed exceptions in Section 15302 of the State CEOA Guidelines. The proposed project involves minor improvements to an existing facility, and would not expand the existing use. Thus, the proposed project would qualify for a Class 1 exemption.
