Reasons for Exemption
The project qualifies for a Class 1 exemption as the use involves the sale of beer and wine for on-site consumption which would occur in an existing facility and involves negligible expansion of the existing use. Additionally, a Class 3 exemption applies to projects that consists of construction and location of limited numbers of new, small facilities, or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. Accessory structures such as garages, carports, patios, swimming pools, and fences are included in this exemption. In this case, the Applicant is proposing a patio to accommodate an outdoor dining area which would be accessory to the restaurant use.
