Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number EPIMS-TRI-09917-R1, pursuant to Section 1602 of the Fish and Game Code to Dominy Wiltse. The project is limited to the diversion of surface water from Hennessey Creek for domestic and non-commercial cannabis irrigation purposes. The Agreement allows for the maintenance of an existing gravity-fed diversion and the diversion of water under License 12172, which allows for 300 gallons of water per day to be diverted by direct diversion year-round for domestic purposes and 0.06 cubic feet per second by direct diversion from April 1-October 20 for non- cannabis irrigation. Water is diverted via a 3-inch PVC pipe stuck into a small rock-stacked, concrete reinforced dam. Maintenance includes cleaning out the screened inlet and removing accumulated sediment and debris from the pool with a shovel or by hand.

The project authorizes an existing ongoing diversion, which has been licensed by the State Water Resources Control Board since the 1970s. Continued use of the diversion at the specified rates will not have substantial adverse impacts to species within the stream.
