Document Description
The Board has approved the Proposed PM10 Maintenance Plan for the South Coast Air Basin (2021 PM10 Plan). As is required by the federal Clean Air Act, the South Coast Air Quality Management District developed a second ten-year maintenance plan of the federal PM10 standard, to be submitted within eight years of the approval of the first ten-year maintenance plan. The second maintenance plan meets this requirement and demonstrates that the District will continue to maintain the PM10 standard through 2035. If approved, the 2021 PM10 Plan will be submitted to the United States Environmental Protection Agency as a revision to California’s State Implementation Plan.

CARB has determined that this item is exempt from CEQA because it is a ministerial activity by CARB (14 CCR § 15268). CEQA Guidelines provide that a “ministerial” decision is one that involves fixed standards or objective measurements, and the agency has no discretion to shape the activity in response to environmental concerns (14 CCR § 15369; San Diego Navy Broadway Complex Coalition v. City of San Diego (2010) 185 Cal.App.4th 924, 934). With the item, CARB has determined that it lacks authority to not approve or otherwise modify it, and so the item is ministerial and exempt from CEQA. A brief explanation of the basis for reaching this conclusion is included in the Staff Report.
